Welcome to Skysnag’s Privacy Policy. We value your privacy and are committed to protecting your personal data. This privacy policy explains how we collect, use, and protect your information when you visit our website www.skysnag.com and use our services. 

Overview

1.1. Objective:

Skysnag Inc. (“Skysnag,” “we” or “us”) provides this Privacy Policy to inform you of our policies and procedures regarding the kinds of identifiable personal identifiable information (“Personal Information”) we may collect, how we intend to use and share that information, and how you can correct or change such information when you access or use our website, www.skysnag.com, together with any and all future websites operated by or on behalf of Skysnag (“Site”) and access to our anti-phishing software and related services (“Services”). We encourage you to read this Privacy Policy in its entirety before submitting any Personal Information, so you know how we collect and share your Personal Information. By using our Site or Services you are consenting to our policies regarding your information, and the ways in which we may collect, use, process, transfer and otherwise deal with that information, as described in this Privacy Policy now and as amended by us.

1.2. Scope.

This Privacy Policy applies to Personal Information that is processed by Skysnag in the course of our business.

2. Information We Collect and How We Use It

2.1 Personal Information

When using our Services, you may provide us with Personal Information, which refers to data that can identify you. This includes, but is not limited to, your name, phone number, billing information, email address, and home and business addresses. We use this Personal Information primarily to provide our services and address your inquiries.

2.2 Non-Identifying Information

We also collect additional information provided during registration and account administration, such as zip codes or preferences, referred to as “Non-Identifying Information.” While some Non-Identifying Information may become part of your Personal Information when combined with other identifiers (e.g., zip code with street address), it remains separate otherwise.

2.3 Use of Personal Information

We utilize both Personal Information and Non-Identifying Information, sometimes combined, to deliver our Services, fulfill transactions, and manage inquiries. Additionally, we may employ Non-Identifying Information for broader purposes like assessing marketing effectiveness and enhancing our Services. We may also use Personal Information to send Skysnag-related updates and marketing materials, with an option to opt out.

2.4 Log Data Collection and Usage

When visiting our Site, whether as a registered user or a visitor, our servers automatically record Log Data, including IP addresses, browser types, visited pages, and search queries. This information helps monitor Service usage, improve functionality, and tailor content to user interests. Log Data isn’t treated as Personal Information unless combined with other identifiers.

2.5 DMARC and DNS Data Collection and Usage

Our email authentication service collects data automatically forwarded to our servers regarding email traffic. This data, generated using standards like DMARC, DNS, DKIM, and SPF, aids in operations and analytics without disclosing Personal Information. This data includes DMARC aggregate reports, DMARC failure reports, and logs of DNS requests for SPF, DKIM, and DMARC records. While DMARC failure reports may contain some header information or content from the affected email message (depending on the receiving domain’s email system settings), we do not collect these reports. The other DMARC and DNS-related reports and logs do not contain any information we consider to be Personal Information. However, some of this data enables us to determine the originating or delivering domain, the originating IP address, and/or the service provider used to send an email message. We log this information and use it for operational and analytical purposes.

2.6 Research/Survey Solicitations

Periodically, Skysnag may conduct research via surveys, with responses used for analysis and service improvement. This might be via Third Party-service providers. We would use this data for the purpose of determining the effectiveness of our Sites, communications, advertising campaigns, and/or promotional activities. Anonymous and aggregate data may be shared for research and analysis purposes. 

2.7 Information Submitted via Sites

Content submitted to us via the Site may be used for various purposes, including product development or marketing, with user consent or appropriate notification.

3. Cookies, and Analytics Information

3.1 Cookies

Skysnag and its third-party suppliers use ‘cookies’ to collect information for Google Analytics, Intercom, and Hotjar. A cookie is a small data file that we transfer to your computer’s hard disk for record-keeping purposes. We may connect the information stored in cookies with the personal information you provide while using our site.

You can choose to not accept cookies on your browser, however, you may not be able to use all functionalities of the Site or our Services.

3.2. Analytics Information

Skysnag might also use Google Analytics and Interest Reporting to collect/assess information visitor behavior on our Sites. 4. Your Decisions and Ability to Withdraw

4.1. General

 You have the right to withdraw certain uses and disclosures of your Personal Information as described in this Privacy Policy. If you have given consent for Skysnag to process your Personal Information, you can withdraw that consent at any time by following the instructions provided in this Section 5 or by submitting a request as described in Section 8. Additionally, if we intend to use your Personal Information for any new purpose not originally authorized by you, we will notify you and give you the opportunity to withdraw before we use your information for that new purpose.

4.2. Communication

Instructions for withdrawing will be included in any email marketing communication from Skysnag. However, we may continue to send you emails related to products or services you have requested in response to such requests. Certain essential communications regarding Skysnag programs and services, such as updates to our Terms of Use or this Privacy Policy, may still be sent to you and you will not be able to opt out of these communications. We maintain “do not call” and “do not mail” lists as required by law, and we process requests to be placed on these lists within 30 days, or sooner if required by law. Registered Skysnag users can limit how and when Skysnag communicates with them via the Skysnag dashboard settings or by contacting us at [email protected]. For email communication, registered Skysnag users can choose to opt out of email communication via the Unsubscribe button.

5. Information Sharing and Disclosure

5.1 General

Skysnag does not sell or otherwise disclose your Personal Information, except as detailed in this Privacy Policy or with your explicit consent. Skysnag strives to ensure that third parties to whom it discloses Personal Information protect it using standards similar to those upheld by Skysnag and to notify Skysnag if they can no longer meet this obligation.

5.2 Aggregate Information and Non-Identifying Information

We may share aggregated information that does not include Personal Information, and we may otherwise disclose Non-Identifying Information, Log Data, and DMARC and DNS data with third parties for purposes such as industry analysis and demographic profiling. Any aggregated information shared in these contexts will not contain your Personal Information.

5.3 Service Providers

We may hire third-party companies and individuals to facilitate our services, provide services on our behalf, perform site-related services (such as maintenance, database management, web analytics, improvement of the Services’ features, and user communications), or help us analyze how our Services are used. These third parties have access to your Personal Information only to perform these tasks on our behalf and are not authorized to disclose or use it for any other purpose.

5.4 Compliance with Laws and Law Enforcement

Skysnag works with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal processes (including subpoenas), to protect the property and rights of Skysnag or a third party, to ensure public or individual safety, or to prevent or stop any activity we consider to pose a risk of being illegal, unethical, or legally actionable.

5.5 Business Transfers

In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy (“Transfer Event”), Skysnag may sell, transfer, or otherwise share some or all of its assets. Personal Data may be disclosed to a third party in the event of a Transfer Event.

6. Other Important Information

6.1. Rights of Access, Rectification, Erasure, and Restriction

Under certain jurisdictional laws, you have the right to confirm if Skysnag is processing your Personal Information, request access to it, and ask that we correct, amend, or delete it if it is inaccurate or processed in violation of the Privacy Shield Principles. Registered users can manage their Personal Information by logging into their accounts, though deleting all information may deactivate the account. We may retain an archived copy of your records as required by law or for legitimate business purposes. You can also request access, restrict processing, seek rectification, or request erasure of your Personal Information using the methods outlined in Section 8 of this Privacy Policy, and such requests will be processed in line with local laws. Skysnag may not be able to provide access in certain situations, such as when the information contains legal privilege, compromises others’ privacy, involves disproportionate burden or expense, or is commercially proprietary. If access is restricted, we will explain why and provide a contact for further inquiries. To protect your privacy, Skysnag will verify your identity before granting access to or making changes to your Personal Information.

6.2. Security

Skysnag is very critical and concerned with securing your information. We employ administrative, physical and electronic measures designed to protect your information from unauthorized access. We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored ‘personal data’ (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on this Site in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system. Please note that no method of transmission over the internet, or method of electronic storage is one hundred percent secure. Therefore, we cannot ensure or warrant the security of any information you transmit to Skysnag.

6.3. International Transfer

Your information may be transferred to, processed and stored on computers, networks and other equipment located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. This includes our own computers and networks as well as those of the cloud-based service providers that provide much of our Services’ infrastructure. This equipment may be located within and/or outside of the United States. Your consent to this Privacy Policy followed by your submission of any information represents your agreement to the transfer of that information as described above.

6.4. Policy Toward Children

This Site is not directed to children under 18. We do not knowingly collect personally identifiable information from children under 13 (and in certain jurisdictions under the age of 16). If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us at [email protected]. If we become aware that a child under 13 (and in certain jurisdictions under the age of 16) has provided us with Personal Information, we will delete such information from our files.

6.5. Phishing

Identity theft and the practice currently known as ‘phishing’ are of great concern to Skysnag. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your account ID, login password, or national identification numbers in an unsolicited email or telephone communication. Our Services may contain links to other websites. If you choose to click on a third-party link, you will be directed to that third party’s website. The Fact that we link to a third-party website or allow advertising of (or otherwise refer to) third-party products or services on our Services is not an endorsement, authorization of representation of our affiliation with that third party, nor is it an endorsement of their privacy of information security policies or practices. We do not exercise control over third-party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit personal information from you. Other sites follow different rules regarding the use or disclosure of the personal information you submit to them. 6.7. Do-not-Track Signals. 

While our Site at this time does not recognize automated browser signals regarding tracking mechanisms, such as “do not track” instructions, you can generally express your privacy preferences regarding the use of most cookies and similar technologies through your web browser, as indicated elsewhere in this privacy policy.

6.8. California Privacy Rights

California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the Third Parties to whom we have disclosed their Personal Information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of Personal Information Disclosed to those parties. Additionally, the California Consumer Privacy Act, Cal. Civ.Code §§ 1798.100 et seq. (“CCPA”) grants consumers certain rights over their personal information, including:

• Right to Know: about any Personal Information used, collected and disclosed to Third Parties
• Right to Deletion: request to delete or destroy any and all Personal Information collected.
• Right to Non-Discrimination: the right to not be discriminated against for exercising rights under CCPA.
